This End-User License Agreement (EULA) is a legally binding agreement between you, the user, and the licensor concerning the software product FlexCryst, including all related components, media, and documentation (the "Software"). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software.
The licensor grants you a non-exclusive, non-transferable, and revocable license to use the Software solely for academic and non-commercial purposes. This license is limited to your personal use for research, study, and teaching. Any commercial use is strictly prohibited.
You are expressly prohibited from the following actions:
Distribution: You may not distribute, lease, sell, sublicense, or otherwise make the Software available to any third party.
Integration: You may not integrate the Software, in whole or in part, into any other software, product, or system.
Modification: You may not modify, decompile, reverse-engineer, or disassemble the Software.
If the Software is used for research that leads to scientific results (e.g., publications, theses, conference presentations), you are obligated to cite the following publication in all resulting works:
"Hofmann, D. W. M., & Kuleshova, L. N. (2023). A general force field by machine learning on experimental crystal structures. Calculations of intermolecular Gibbs energy with FlexCryst. Foundations of Crystallography, 79(2), 132-144."
The Software is provided "as is" and without any warranty of any kind, whether express or implied. The licensor rejects any responsibility for the results of its use or for any direct or indirect damages, including loss of data, business interruption, or other financial loss, arising from the use or inability to use the Software. The use of the Software is entirely at your own risk.
This EULA shall be governed by the laws of the Federal Republic of Germany. The Amtsgericht Erlangen (Local Court of Erlangen) shall be the exclusive place of jurisdiction for any disputes arising from this agreement.
